elementor-size-default\">Nueva regulaci\u00f3n en materia de transparencia y protecci\u00f3n de datos personales.<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a0ee894 elementor-widget elementor-widget-text-editor\" data-id=\"a0ee894\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>El pasado 20 de marzo de 2025, se public\u00f3 en el Diario Oficial de la Federaci\u00f3n un decreto mediante el cual, se expiden nuevas leyes en materia de transparencia y protecci\u00f3n de datos personales, abrogando las anteriores. Esto para garantizar el acceso a la informaci\u00f3n p\u00fablica; fortalecer la protecci\u00f3n de la privacidad de las personas; homologar la legislaci\u00f3n nacional con los est\u00e1ndares internacionales en la materia; actualizar las normas ante el uso de medios electr\u00f3nicos y reducir el gasto p\u00fablico.<\/p><p>Such decree became effective the day after its publication, and among the most relevant changes is the creation of a new decentralized body of the Anti-Corruption and Good Governance Ministry called \u201cTransparency for the People\u201d, which replaces the National Institute of Transparency, Access to Information and Protection of Personal Data. In addition, the functions of access to public information are redistributed among (i) Transparency for the People; (ii) the control and discipline body of the Judicial Power of the Federation; (iii) the internal control units of the autonomous constitutional bodies (if any); (iv) the comptrollers of the Congress of the Union; (v) the Federal Center for Labor Conciliation and Registration and the Federal Court of Conciliation and Arbitration, in relation to labor unions, and (vi) the National Electoral Institute, with respect to political parties.<\/p><p>En la nueva Ley General de Acceso y Transparencia a la Informaci\u00f3n P\u00fablica, expresamente se establece que no podr\u00e1 clasificarse como reservada la informaci\u00f3n relacionada con violaciones graves a los derechos humanos o delitos de lesa humanidad, aunque hacen m\u00e1s extensa la lista de criterios para considerar la informaci\u00f3n como reservada. Asimismo, se establece que ninguna persona podr\u00e1 ser objeto de inquisici\u00f3n judicial o administrativa por ejercer su derecho de acceso a la informaci\u00f3n, ni se podr\u00e1 restringir este derecho por medios directos o indirectos.<\/p><p>En la nueva Ley General de Protecci\u00f3n de Datos Personales en Posesi\u00f3n de Sujetos Obligados, se reduce la definici\u00f3n de las entidades consideradas sujetos obligados, omitiendo a sindicatos y personas privadas (f\u00edsicas o morales) que reciban recursos p\u00fablicos o realicen actos de autoridad.<\/p><p>En la nueva Ley Federal de Protecci\u00f3n de Datos Personales en Posesi\u00f3n de los Particulares se modifican ciertas definiciones importantes, tales como: Aviso de Privacidad; Base de Datos; Consentimiento; Datos Personales; Fuentes de Acceso P\u00fablicas; Tratamiento de Datos y Transferencia de Datos.<\/p><p>Asimismo, se modifican los requisitos que debe contener el aviso de privacidad y se establece la obligaci\u00f3n por parte de los responsables de contar con los datos personales correctos y vigentes. Tambi\u00e9n se prev\u00e9n nuevas modalidades para revocar el consentimiento y en general se refuerzan los lineamientos para el tratamiento de la informaci\u00f3n confidencial.<\/p><p>Las resoluciones de la Secretar\u00eda Anticorrupci\u00f3n y Buen Gobierno \u00fanicamente podr\u00e1n impugnarse mediante juicio de amparo ante juzgados y tribunales especializados que habilitar\u00e1 el Poder Judicial de la Federaci\u00f3n.<\/p><p>A la luz de lo anterior, ser\u00e1 importante revisar y ajustar las pol\u00edticas internas y los avisos de privacidad;
